Hazardous Waste Management System; Identification and Listing of Hazardous Waste; Proposed Exclusion

The Environmental Protection Agency (EPA or Agency) today is proposing to grant a petition submitted by Bethlehem Steel Corporation (``BSC''), Lackawanna, New York, to exclude (or ``delist''), on a one- time basis, certain solid wastes contained in a landfill from being listed hazardous wastes. Based on careful analyses of the waste- specific information provided by the petitioner, the Agency has concluded that BSC's petitioned waste will not adversely affect human health and the environment. This action responds to BSC's petition to delist these wastes on a ``generator-specific'' basis from the hazardous waste lists. If the proposed decision is finalized, the petitioned waste will not be subject to regulation under Subtitle C of the Resource Conservation and Recovery Act (RCRA).
